Weight Loss: SlimPanda Terms & Conditions

These terms and conditions apply to the Weight Loss: SlimPanda app (hereby referred to as the "Application") for mobile devices that was created by MD TECH (hereby referred to as the "Service Provider") as a Commercial service.
Acceptance of Terms
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
Application Features and Services
The Application provides health, fitness, and weight management tools, including:
- Calorie tracking through manual entry, AI-powered photo scanning, and AI-powered text description
- Water intake tracking
- Weight logging and progress tracking
- Activity tracking via Apple HealthKit integration
- AI-powered health coaching (SlimPanda Coach)
- Smart reminders for walking, standing, and hydration
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider will never charge you for the Application or its services without making it clear to you exactly what you are paying for.
AI-Powered Features
The Application includes features powered by artificial intelligence through OpenAI's API:
1. AI Calorie Estimation: The Application can estimate calories and nutritional information from food photos you take or food descriptions you type. These estimates are generated by AI and may not be perfectly accurate. You should use them as approximate guides, not as precise measurements.
2. AI Coach (SlimPanda Coach): The Application provides an AI-powered coaching feature that can review your food logs, water intake, weight history, activity data, and health goals to offer personalized suggestions and motivation.
By using these AI-powered features, you acknowledge and agree that:
- Your data (as described in the consent prompts and Privacy Policy) is sent to OpenAI's servers for processing.
- You must provide explicit consent through the in-app consent prompt before any data is shared with OpenAI.
- AI-generated calorie estimates are approximations and may vary from actual values. The Service Provider does not guarantee the accuracy of any AI-generated content.
- AI coaching advice is for informational and motivational purposes only. It does not constitute medical, nutritional, or professional health advice.
- You should consult a qualified healthcare professional before making significant changes to your diet, exercise routine, or health plan based on information provided by the AI Coach.
- The Service Provider is not liable for any health outcomes, dietary decisions, or actions taken based on AI-generated content.
- OpenAI processes your data in accordance with OpenAI's API data usage policy. Data submitted via the API is not used by OpenAI to train its AI models.
Apple HealthKit Integration
The Application may access health and fitness data from Apple HealthKit with your explicit permission, including step count, active energy burned, standing hours, and other health-related metrics.
By granting HealthKit access, you agree that:
- HealthKit data is used solely to display your activity progress and to provide personalized coaching through the AI Coach feature.
- HealthKit data is never used for advertising, marketing, or data-mining purposes.
- HealthKit data is only shared with OpenAI through the AI Coach feature if you have separately consented to AI Coach data sharing.
- You may revoke HealthKit permissions at any time through the Apple Health app or your device Settings.
Subscriptions and Payments
Certain features of the Application may require a paid subscription. Subscription details, pricing, and terms are presented within the Application before purchase. Subscriptions are processed through Apple's App Store and are subject to Apple's terms and conditions for in-app purchases.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription through your Apple ID account settings.
- Refund requests are handled by Apple in accordance with their refund policy.
Third-Party Services
The Application relies on the following third-party services to function:
- OpenAI: provides AI-powered calorie estimation and coaching features
- Google Firebase: provides user authentication, data storage, and server-side processing
- RevenueCat: manages subscription status and in-app purchases
- Apple HealthKit: provides health and fitness data with your permission
Each third-party service operates under its own terms of service and privacy policy. The Service Provider is not responsible for the practices of these third-party services.
Data and Device Security
The Application stores and processes personal data that you have provided to the Service Provider in order to deliver the services. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your phone, as such actions could expose your phone to malware, viruses, and malicious programs, compromise your phone's security features, and cause the Application to malfunction.
Internet Connectivity
Certain functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of Wi-Fi or data allowance. If you are using the Application outside a Wi-Fi area, your mobile network provider's terms still apply, and you may be charged for data usage.
Limitation of Liability
The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on the functionality of the Application. This includes but is not limited to:
- Inaccurate AI-generated calorie estimates or nutritional information
- AI coaching advice that may not be suitable for your specific health conditions
- Interruptions in service due to third-party service outages
- Loss of data due to circumstances beyond the Service Provider's control
The Application is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.
Updates and Termination
The Service Provider may update the Application from time to time. The Application is currently available as per the requirements for the operating system, and the need for updates may arise. The Service Provider does not guarantee that it will always update the Application to remain relevant or compatible with your device.
The Service Provider may also wish to cease providing the Application and may terminate use of it at any time without giving notice of termination to you. Upon termination, the rights and licenses granted to you in these terms will end, and you must stop using the Application and delete it from your device if necessary.
Changes to These Terms
The Service Provider may periodically update these Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the updated Terms and Conditions on this page and updating the effective date.
